PAYMENT: The accepted forms of payment are Cash, Personal or Business Checks, Wire Transfer, Credit Card. Be advised of the 4% convenience fee applied to all credit card, debit card. Powell Farms Inc. reserves the right to charge the purchaser’s credit card on file an amount up to the full purchase price plus storage fees for items not paid for and pickup up in a timely manner.
TERMS AND CONDITIONS: All items sell as-is, where-is with no warranties or guarantees by Powell Farms Inc. or its employees. Pictures & descriptions are for use as a guide only. Buyer is responsible for inspection of equipment to determine quality and value prior to bidding. All sales are final and binding.
SALES TAX INFORMATION: Kentucky sales tax of 6% will apply to all items. Dealers will need to send a copy of the resale certificate to have sales tax removed prior to payment. Farmers will need to execute a KENTUCKY agriculture exemption number to have sales tax removed prior to payment. All out of state buyers must have a KENTUCKY agriculture exemption number to be tax exempt, effective January 1st 2023.
Not all items are exempt! Examples: Lawn & Garden, Equipment 5′ wide and under. Please contact with any specific questions.
LOAD OUT: Load out Jan 18th – Jan 31st, Monday-Saturday 8am-5pm. Buyer is responsible for all shipping logistics and costs.
Items not picked up after 30 days after the auction, will incur a daily storage fee.
Items not picked up 60 days after the auction will be considered abandoned and will be disposed of.

Tax Exemption: A new Kentucky law requires that local and out of state farmers must apply for an KY Agriculture Exemption Number to make qualified purchases for the farm exempt from sales tax.
The Application for the Agriculture Exemption Number, Form 51A800, is available at www.revenue.ky.gov under Sales Tax forms. Completed applications should be submitted by email to DOR.Webresponsesalestax@ky.gov or mailed to DOR’s Division of Sales and Use Tax, Station 66, P.O. Box 181, Frankfort, KY 40602-0181.
